Terms of Service

1. Acceptance of terms

These Terms of Service (“Terms”) are a contract between you and NovelCraft (“NovelCraft”, “we”, “us”) for use of https://www.novelcraft.ai and related products (the “Service”). By creating an account, paying for a plan or using the Service you agree to these Terms, the Privacy Policy and the Refund Policy. If you do not agree, do not use the Service.

You must be at least 18 years old and able to form a binding contract. Bedtime Stories are written by adults for children; children may not create accounts or provide personal information to us.

2. The Service

NovelCraft is an AI-assisted writing platform. It helps you outline, draft, edit and publish stories, including optional cover art and bedtime-story formats. Output depends on your prompts, the models we call and the limits of your plan. We do not guarantee a particular literary quality, originality or commercial result.

3. Accounts

You are responsible for:

• Keeping login credentials confidential
• All activity under your account
• Telling us promptly about unauthorised use at legal@novelcraft.ai

We may refuse, suspend or close accounts that we reasonably believe are abusive, fraudulent or in breach of these Terms.

4. Subscriptions, renewal and taxes

Paid features require a subscription. Current self-serve prices are shown on the site in US dollars before tax. Enterprise pricing is agreed separately. By subscribing you:

• Authorise Stripe Managed Payments (Link) to charge your payment method for the plan you select, plus applicable tax
• Agree that the subscription renews automatically each billing period (monthly, unless we offer another interval) at the then-current price until you cancel
• Can cancel at any time in Settings → Billing or through Link, where Stripe hosts order management
• Keep access until the end of the period already paid; we do not prorate unused time except where the law requires it or our Refund Policy says otherwise

Self-serve paid plans are sold through Stripe Managed Payments. Stripe (through Link) is the merchant of record for those purchases: bank statements typically show LINK.COM* plus our statement descriptor, and Stripe calculates, collects and remits sales tax, VAT and GST in the countries Managed Payments supports. NovelCraft still provides the writing service. Listed prices exclude tax unless a price is marked tax-inclusive in Stripe. Enterprise pricing, if invoiced outside Managed Payments, is a direct contract with us.

We may change prices with notice before the next renewal. If you do not cancel, the new price applies to the following period. Failed payments are retried by Stripe; if they keep failing, the paid plan ends and the account returns to Free.

5. Digital services and withdrawal

The Service is digital content and online services supplied immediately after payment so you can generate text and images. If you are a consumer in the EEA, UK or a similar regime with a 14-day cooling-off right, that right is lost once we start performing the service, provided you asked us to start immediately and acknowledged the loss of the right. Checkout asks you to confirm that.

Statutory rights that cannot be waived still apply. Details are in the Refund Policy.

6. Content and AI output

Your inputs. You keep ownership of prompts, notes, manuscripts and other material you provide, and you grant us a licence to host, process and display them solely to operate the Service.

Generated output. Subject to these Terms and the rights of third-party model providers, we assign to you the rights we have in text and images generated for you so you may use them for personal and commercial purposes, including publication and sale. You are responsible for reviewing output before you publish it.

No warranty of uniqueness. Similar prompts can produce similar output for other users. AI may invent facts, quote or resemble existing works, or generate content that is unusable in your jurisdiction. You must not treat output as legal, medical or professional advice.

Platform rights. We may use anonymised, aggregated usage data to improve the Service. We do not use your story manuscripts to train third-party foundation models unless you give a separate explicit consent.

7. Acceptable use

You agree not to use the Service to:

• Generate or distribute content that is illegal, or that sexualises minors in any way
• Infringe copyright, trademarks, publicity or other rights
• Create malware, scams, or content intended to defraud or harass
• Attempt to extract model weights, bypass plan limits or probe other users’ data
• Share account credentials or resell access except as we expressly allow
• Use automated systems beyond reasonable use of our published APIs or export tools

We may remove content, throttle usage or terminate accounts that break this section. Public community posts must also follow the community library rules below.

8. Community library

If you publish a book or character to the community library:

• You grant us a non-exclusive licence to host, display and distribute it on the Service
• You represent that you have the rights to publish it, including any AI-assisted parts
• We may remove listings that break these Terms or attract a valid complaint

9. Copyright complaints

If you believe content on the Service infringes your copyright, email legal@novelcraft.ai with: your contact details, a description of the work, the URL of the allegedly infringing material, a statement that you have a good-faith belief the use is unauthorised, and a statement under penalty of perjury that the notice is accurate and that you are the owner or authorised to act. We may remove the material and, in appropriate cases, terminate repeat infringers.

10. Third-party processors

Payments for self-serve plans are sold through Stripe Managed Payments. Stripe and Link handle card processing, tax collection, receipts and disputes for those transactions. Generation may be processed by AI providers such as OpenAI and Anthropic under their terms. We are not those companies, and their outages or policies can affect the Service. See the Privacy Policy for the list of processors.

11. Disclaimers and liability

The Service is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We are not liable for:

• Indirect, incidental, special, consequential or punitive damages
• Lost profits, lost data or business interruption
• AI output that is inaccurate, offensive or alleged to infringe third-party rights

Our total liability for a claim relating to the Service is limited to the fees you paid us in the twelve months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep rights that the law does not allow us to exclude.

12. Indemnity

You will defend and indemnify NovelCraft against claims arising from your content, your publication of generated output, or your breach of these Terms, except to the extent a claim is caused by our wilful misconduct.

13. Termination

You may delete your account in Settings. Deletion cancels any Stripe subscription and removes personal data as described in the Privacy Policy. We may suspend or terminate the Service or your account if you break these Terms. After termination you should export anything you need; remaining copies may be deleted after a reasonable period.

14. Changes

We may update these Terms. Material changes will be announced by email or in the Service. The “Last updated” date at the top of this page is the effective date. Continued use after that date means you accept the updated Terms, except where the law requires opt-in consent.

15. Governing law

These Terms are governed by the laws of the place where NovelCraft is established, without regard to conflict-of-law rules. If you are a consumer in the EEA, UK or Switzerland, you also have the protection of the mandatory consumer laws of your country of residence, and you may bring proceedings in your local courts.
